But the spirit of Texan bettors remained unbowed, and they continued wagering, albeit illegally, during horse races. A good example is the inaugural horse racing season at the Arlington Downs in November 1929, where William T. Waggoner made about $67,000 from 66 races. It is estimated that he lost about $50,000 that season alone due to the deficiencies of the pari-mutuel betting system at that time.

A New Hope in the Great Depression

As fate would have it, the Great Depression came calling in 1929. Tough economic times made the Texan legislature rethink its position on pari-mutuel gambling. In 1933, this year brought good tidings to horse racing bettors; the state and the legislature passed a law that legalized pari-mutuel betting to raise revenue collection. This legislation also created the Texas Racing Commission to regulate gambling activities on horse racing.

Unfortunately, the good times didn’t last long. After four short years, the legislature defied pari-mutuel betting by banning all gambling activities. The ban lasted for half a century and saw many dreams of investors in race tracks go up in smoke.
